User Terms & Conditions – 360 Avenues WhatsApp CRM Effective Date:01 March 2025 Welcome to 360 Avenues WhatsApp CRM. By registering for and using our platform, you agree to comply with and be bound by these User Terms & Conditions. If you do not agree to these terms, please do not proceed with registration or use our services. --- 1. Acceptance of Terms By creating an account and using the 360 Avenues WhatsApp CRM platform, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, as well as any applicable policies set forth by WhatsApp, Meta (Facebook), and 360 Avenues LLC FZ. 2. WhatsApp Cloud API & Conversation-Based Pricing - Our platform operates on the WhatsApp Cloud API, which is owned and managed by Meta (Facebook). - WhatsApp applies conversation-based pricing, meaning that charges are per conversation. - WhatsApp sets and controls the pricing mechanism and rates, which may be updated or modified at any time without prior notice. - By using 360 Avenues WhatsApp CRM, you acknowledge and agree that you will be billed according to WhatsApp's pricing structure and mechanism and that any pricing changes by WhatsApp will automatically apply to your usage. 3. Meta (Facebook) Business Approval & Limitations - As 360 Avenues WhatsApp CRM is built to integrate with Whatsapp Cloud API/Meta (Facebook) tools, all businesses/vendors using our platform must be approved by Meta (Facebook)/WhatsApp before accessing WhatsApp Business services. - Approval, verification, and account acceptance are solely at Meta (Facebook)’s discretion, and 360 Avenues FZ LLC has no control over these decisions. - 360 Avenues LLC FZ is not responsible for any delays, rejections, suspensions, or terminations made by Meta (Facebook)/WhatsApp regarding your business account. 4. User Responsibilities By using our platform, you agree to: - Provide accurate and verifiable business details as required for WhatsApp Business API approval. - Comply with WhatsApp’s policies, including but not limited to messaging rules, prohibited content, and data privacy guidelines. - Accept all WhatsApp charges, including any future changes made by WhatsApp. - Acknowledge that 360 Avenues LLC FZ is not liable for any actions taken by WhatsApp, Meta (Facebook), or related third-party platforms. 5. Platform Usage & Compliance - Users must not engage in spamming, unauthorized promotions, or sending prohibited content through WhatsApp. - Violations of WhatsApp's Acceptable Use Policy may result in account suspension or termination by WhatsApp or Meta, and in this case 360 Avenues LLC FZ will not be responsible for any matter. - 360 Avenues reserves the right to suspend or terminate access to its platform if a user is found to be in violation of these terms. 6. Limitation of Liability - 360 Avenues provides the WhatsApp CRM platform "as is" and makes no guarantees regarding continued access, performance, or approval by WhatsApp/Meta. - 360 Avenues is not responsible for any financial losses, business disruptions, or reputational damages resulting from actions taken by WhatsApp, Meta (Facebook), or other third-party service providers. - Users acknowledge that WhatsApp pricing, policies, and approval processes are beyond 360 Avenues LLC FZ control, and any disputes related to these matters must be addressed with WhatsApp/Meta directly. 7. Changes to Terms & Conditions - 360 Avenues LLC FZ reserves the right to update or modify these Terms & Conditions at any time. - Continued use of the platform after such updates constitutes acceptance of the revised terms. 8. Agreement & Acceptance By registering for and using 360 Avenues WhatsApp CRM, you: ✅ Accept these Terms & Conditions in full. ✅ Acknowledge that WhatsApp sets pricing and may change it at any time. ✅ Understand that Whatsapp/Meta (Facebook) controls business approvals, and 360 Avenues LLC FZ is not responsible for any decisions made by Meta/WhatsApp. If you do not agree to these terms, please do not proceed with registration or usage of 360 Avenues WhatsApp CRM.
